My best friend's Air Force husband kicked her out of the house!What rights does she have as a military spouse?

She goes shopping a lot and gets on the computer a lot, so he is accusing her of cheating on him! He has no proof, but yet he took her house key and made her leave the house! My husband told me that the rules favor the wife when it comes to the military, I would like to know what they are!|||It depends.





If they live off post he can kick her out if he wants, but he still has to provide for her. His BAH is for her not him, so he must provide for her. She just needs to go to legal.





If they live in housing then he cannot kick her out. Again, housing isn't for him it's for her, so in that situation he would have to go.





Until they are legally DIVORCED the law will favor her. She just needs to go to legal.|||The service member is given a BAH at a with dependent rate for the specific purpose of providing housing for his dependents. If anything, he should leave the house.





If he will not let her back in within 24 hours, she should her dependent ID and go to the legal office on base and file a formal complaint against him. At the very least, they will order him to pay her enough to survive on if he will not let her back in the house.|||sounds like a good man!!tell her to get her butt off the computer,stop spending all the money and do somthing to help him out,she sounds pretty selfish ,probably servers her right,.....wake up ,girl!!|||Same as anyone else,she doesnt get any specail will priveledges...but she will lose her base pass and medical insurance,|||yea if he doesn't let her back in the house then she can go to legal and he will loose the money he is allotted for rent or if he is in base housing he will have to give up his house now cause they don't give base housing to just 1 person so he will be in for a surprise. she should also talk with the base Chaplin because secretly he is one of the most powerful people on the base and can help her immediately.|||Tell her to call the Mp's....They will more than likely have him leave and place a no contact order, I believe its for 72 hours. It goes down as a domestic on his record though....Good luck to her...|||If they separate, they will lose the military housing. The housing is based on his service,not on her need. If they have children he will still be allowed to have the housing, even if she is not there, but the children are . This is only if they live in government housing. Private housing problems will be dealt with by the local agencies. However, she can make a complaint to the agencies on the military base. They can advise her of her rights.|||Have her call his first sergeant, he/she will meet them at their house to mediate the situation and if necessary have him move out and move into a dorm on base for a certain time. They'll probably have to go through some counseling afterwards, but depends on the severity of the situation. It may get a little embarassing for him, but if he's kicking her out without a dialogue then he probably deserves it.
